Privacy policy and data processing

The present Personal Data Privacy Policy (hereinafter - Privacy Policy) applies to all information that the Association of Legal Entities in the form of Association "International Center for Development of Oil and Gas Machine Building" (hereinafter - IMB Center), located on the domain name www.imbc.kz, may obtain about the User during the use of the website www.imbc.kz.

1. DEFINITION OF TERMS
1.1 The following terms are used in this Privacy Policy:
1.1.1 " Administration of the site www.imbc.kz (hereinafter - the Website Administration) " - authorized employees to manage the site, acting on behalf of the Association of Legal Entities in the form of Association "International Center for Development of Oil and Gas Machine Building", which organizes and (or) carries out the processing of personal data, as well as determines the purposes of personal data processing, the composition of personal data subject to processing, actions (operations) performed with personal data.
1.1.2. "Personal Data" is information relating to a certain or determined on their basis subject of personal data, recorded on electronic, paper and (or) other tangible medium.
1.1.3"Processing of personal data" means any action (operation) or set of actions (operations) performed with or without the use of automation means with personal data, including collection, recording, systematization, accumulation, storage, clarification (update, change), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, destruction of personal data.
1.1.4. " Personal data confidentiality" means the requirement, which IMB Center or any other person who has obtained access to personal data, is obliged to comply with to prevent their dissemination without the consent of the personal data subject or other legal basis.
1.1.5. "User of the website www.imbc.kz (hereinafter referred to as "User")" - a person who has access to the Website by Internet and uses the Website www.imbc.kz.
1.1.6. "Cookies" is a small piece of data sent by a web server and stored on the user's computer, which a web client or web browser sends to the web server in an HTTP request each time it tries to open a page of the relevant website.
1.1.7. "IP address" means the unique network address of a host on an IP-based computer network.

2. GENERAL REGULATIONS

2.1 The User's usage of www.imbc.kz means consent to this Privacy Policy and the terms of processing the User's personal data.
2.2 In case of disagreement with the terms of the Privacy Policy, the User must stop using the site www.imbc.kz.
2.3.This Privacy Policy applies only to the site www.imbc.kz. The site does not control and is not responsible for the sites of third persons, to which the User can go through the links available on the site www.imbc.kz.
2.4 Administration of the site does not verify the accuracy of personal data provided by the User of the site www.imbc.kz.
 
3. PRIVACY POLICY
 
3.1 This Privacy Policy establishes the obligations of the Administration of the site www.imbc.kz on non-disclosure and ensuring the protection of confidentiality of personal data that the User provides at the request of the Administration of the site when registering on www.imbc.kz.
3.2. Personal data, authorized for processing under this Privacy Policy, is provided by the User by filling out the registration form on the site www.imbc.kz and includes the following information:
3.2.1. Company name;
3.2.2. Full name of the User;
3.2.3. Position;
3.2.4. BIN;
3.2.5. E-mail;
3.2.6. Phone number;
3.2.7. Company website;
3.2.8. Number of employees;
3.2.9. Address;
3.2.10. Certificates;
3.2.11. Products manufactured;
3.2.12. Experience of delivery to oil and gas companies;
3.2.13. CT-KZ certificates;
3.2.14. Supplier qualifications.
3.2.15. Other documents of the Supplier.
3.3. www.imbc.kz protects Data that is automatically transmitted while viewing advertising blocks and visiting pages on which the system's statistical script ("pixel") is installed:
- IP address;
- cookie information;
- browser information;
- access time;
- referrer (address of the previous page).
3.3.1. Disabling cookies may result in inability to access parts of www.imbc.kz that require authorization.
3.3.2. www.imbc.kz collects statistics on the IP addresses of its visitors. This information is used for the purpose of identifying and solving technical problems.
3.4.    Any other personal information not specified above (used browsers and operating systems, etc.) is subject to secure storage and non-dissemination, except as provided in clauses 5.2. and 5.3. of this Agreement. 5.2. and 5.3. of this Privacy Policy.

4. PURPOSES OF COLLECTION OF USER'S PERSONAL DATA
4.1 The Administration of the site www.imbc.kz may use the User's personal data for the purposes of:
4.1.1. Identification of the User, registered on the site www.imbc.kz, for work with the portal www.imbc.kz.
4.1.2. Providing the User with access to personalized resources of the Website www.imbc.kz.
4.1.3. Establishing feedback with the User, including sending notifications, inquiries regarding the use of the Site www.imbc.kz, processing requests and applications from the User.
4.1.4. Determination of the User's location to ensure security, fraud prevention.
4.1.5. Confirmation of reliability and completeness of personal data provided by the User.
4.1.6. Creating an account for downloading generalized technical requirements of oil and gas Operators (Tengizchevroil LLP, North Caspian Operating Company N.V. and Karachaganak Petroleum Operating B.V.), if the User has read and accepted the terms of the Non-Disclosure Agreement. 
4.1.9. Providing the User with effective customer and technical support in case of any problems related to the use of www.imbc.kz.
4.1.10. Providing the User with its consent, product updates, special offers, newsletters and other information on behalf of www.imbc.kz.
4.1.12. Providing the User with access to the websites of the Association Members, Association Council Members, OEMs, investors www.imbc.kz in order to obtain additional information.

5. METHODS AND TERMS OF PERSONAL DATA PROCESSING
5.1. The User's personal data shall be processed without time limit, by any lawful means, including in personal data information systems with or without the use of automation tools.
5.2. The User agrees that the Administration of the site has the right to transfer personal data to oil and gas Operators, as well as state authorities for familiarization purposes.
5.3. Personal data of the User may be transferred to authorized state authorities of the Republic of Kazakhstan only on the grounds and in accordance with the procedure established by the legislation of the Republic of Kazakhstan.
5.4.  In case of loss or disclosure of personal data, the Administration of the site informs the User about the loss or disclosure of personal data.
5.5. The Administration of the site takes the necessary organizational and technical measures to protect the User's personal information from unlawful or accidental access, destruction, modification, blocking, copying, distribution, as well as from other unlawful actions of third persons.

6. BASIC RIGHTS AND OBLIGATIONS OF THE SIDES
6.1.    The User is obliged:
6.1.1. Provide reliable information about personal data necessary for using the Website www.imbc.kz.
6.1.2. Update, supplement the provided information about personal data in case of changes in this information.
6.1.3. fulfill other obligations provided for by the Law of the Republic of Kazakhstan "On Personal Data and their Protection".
6.2.    The site Administration is obliged to:

6.2.1. Use the received information exclusively for the purposes specified in clause 4 of this Privacy Policy.
6.2.3. Take precautionary measures to protect personal data from unauthorized or accidental access to them, destruction, modification, blocking, copying, provision, dissemination of personal data, as well as from other unauthorized actions in relation to personal data.
6.2.4. Block personal data related to the respective User from the moment of application or request of the User or his/her legal representative or authorized body for the protection of the rights of personal data subjects for the period of verification, in case of detection of unreliable personal data or unlawful actions.
6.2.4. Stop transfer (distribution, provision, access) of personal data, stop processing and destroy personal data in the manner and cases stipulated by the Law of the Republic of Kazakhstan "On personal data and their protection".
6.2.6. Perform other duties provided for by the Law on Personal Data and their Protection of the Republic of Kazakhstan.

7. RESPONSIBILITIES OF THE SIDES
7.1. Persons who transferred to the Administration false information about themselves, or information about another subject of personal data without the consent of the latter, shall be liable in accordance with the legislation of the Republic of Kazakhstan.

8. DISPUTE RESOLUTION
8.1. Before filing a claim with the court for disputes arising out of the relationship between the User of the site www.imbc.kz and the Administration of the site, it is mandatory to submit a claim (a written proposal for voluntary settlement of the dispute).
8.2. The recipient of the claim within 30 calendar days from the date of receipt of the claim, shall notify the applicant of the claim in writing of the results of consideration of the claim.
8.3. In case of failure to reach an agreement, the dispute is transferred to the judicial authorities in accordance with the current legislation of the Republic of Kazakhstan in the courts of Astana.
8.4. The current legislation of the Republic of Kazakhstan shall apply to this Privacy Policy and relations between the User and the Administration of the site.

9. ADDITIONAL TERMS AND CONDITIONS
9.1. The Administration of the site has the right to make changes to this Privacy Policy without the User's consent.
9.2. The new Privacy Policy comes into operation from the moment of its placement on the Site www.imbc.kz, unless otherwise provided by the new version of the Privacy Policy.
9.3. All suggestions or questions regarding this Privacy Policy should be communicated through the Website www.imbc.kz in the Contact Us section (www.imbc.kz/contacts).
9.4. The current Privacy Policy is available at www.imbc.kz.
